STORY: Starbucks has been ordered by a federal judge to face

a lawsuit claiming its fruit drinks lack a key ingredient

Consumers have complained the company's Refreshers

didn't contain the advertised mango, passion fruit or açai

The plaintiffs say they are overcharged

for fruit drinks with misleading names

and that this violates their states’ consumer protection laws

In seeking a dismissal, Starbucks said the names

describe the drinks’ flavors, not their ingredients

The company also said no reasonable

consumers would have been confused

The judge disagreed but he did dismiss a fraud claim,

finding no proof Starbucks intended to defraud customers
